Is my AIV system active?

I have a 300zx with a 1990 body and an engine manufactured on August 1993. It still has all the AIV components behind the fender lining but there is no AIV solenoid with the vacuum line in the engine compartment. I know this system doesn't affect performance but is it affecting my emissions? I have to do the smog test next month and since last time it didn't pass im sure it won't pass again.

the aiv conects ot the ehaust, if the exhaust is still stock I doubt they'll look for the solenoid

and I don't knwo how they qualify these things but your 93 engine never had and aiv, so you might not have to have it
