I'm having a similar problem. I just picked up my (new to me) '06 M35x this morning, and everything works except for the intelligent key. I replaced the battery and still nothing. I'm a bit surprised that it works in it's little docking station, but does not provide any other functionality actually.
I have a second intelligent key that needs to be paired to the car, which I plan on doing tomorrow. If the second key works, I will have to assume the original is broken. I should hopefully have an update sometime tomorrow.
Just got back from the dealer, and they will be keeping it for a day or two (they are going to also fix the A/C lower fan speed button that is sticking). Hopefully I can tell you what I find out soon.

If you know that your remote batteries are indeed still holding a charge and you have replaced them. You may have a problem with your ADP system. This controls all of the effected components you mentioned. It may be something simple like a travel distance sensor, or a UART code. Cant wait to hear what they find

Still waiting to get my car back. To fix the A/C fan speed button, they need to replace the entire panel, so I was told probably tomorrow.
The intelligent key issue is supposedly fixed, but I got that information from the service rep (don't know if all dealers are the same, but at this one, you don't speak with any techs... just reps), so I'm getting a "filtered" version. Sounds like they basically had to reprogram the key as I was only charged for a new battery (which I told them a new one was just put in before bringing it in). I'll know more once it's picked up though... the itemization should show any warranty work.

I finally got my car back yesterday, and was told the key just needed to be reprogrammed due to the battery needing to be replaced.
I'm hoping the service adviser was just not thinking about his explanation. I would hate to think that we need to get the keys reprogrammed every time the battery goes dead (I know it's not that often... but still). Now maybe it was because this remote had dead batteries for an extended period of time, and that caused the issue?
On a side note, the issue that kept the car at the dealer for so long, was having to wait on a new nav control panel. They had to replace the entire panel to fix the "sticking" A/C fan speed button. I was so glad for the warranty, I think the part was something like $700!
