Audi owner gets booted, and is sticking it to them.... or getting stuck himself?

Original Thread: http://forums.vwvortex.com/zerothread?id=3880087

Condensed Version: http://www.gtplanet.net/forum/...60584

I have been speaking with Blake on IM, and via Email. He is really getting railroaded.

The parking enforcement schmuck, is using his company's attorneys and they are going after Blake for invasion of privacy, for posting his picture on the internet.

Then attach a huge sign above the two boots that says "BEWARE OF BOOT"

this is very close to the reason the thread was locked. We are currently discussing how we want to proceed, but until then, the thread will remain locked.

It will help your cause very much to just lay low and let us figure this out. Making 32451432 threads about why the 1st was locked will just cause more problems.

legal system sucks.

Most of our projects focus on taking apart a perfectly good car and screwing it up. At least that's what the masses would think. In personalizing, customizing, and focusing our cars on performance above all else, we inevitably upset the delicate balance of ride and handling, horsepower and fuel economy, and perhaps even styling and anonymity that the OEM spent so many billions of dollars to achieve. Whatever, we think they're better.

That is the ramblings of a scared company who knows that they are looking like the keystone cops of parking. After this runs its course, I'm hopeful that APS will lose customers and find it difficult to attract new ones. I'd love to see that thread continue here.

I found this and thought I'd share it. I've never even seen a boot, so I don't know if this works or not.

The Denver Boot is a simple mechanism that is far more intimidating than it is effective, should you try to remove it yourself. The boot's orange paint and hard steel are all basically a deterrent. The lockbox and padlock are, to be fair, practically indestructible. Unless you have an industrial saw with you, there is no way to take off a boot by removing the lock or destroying the locking mechanism. There are, however, various pins and bolts that can be removed to take the boot off your car, but all such methods still require tools that you probably don't have and will take so long that you run the risk of getting caught and getting another sizable ticket for your impudence. I didn't consider any of these methods feasible. I also didn't want to harm the boot in any way or steal it, as I would be damaging city property. I just wanted to leave it lying there on the sidewalk as I drove away with a maniacal laugh. I found a method to do just that.

Removing the boot without tools or damage is actually a very simple matter. Simply let out about half of the air from the "booted" tired. Once you let the air out the prong that holds the boot in place can be slid past the tire, exposing the hubcap. I had initially intended to change the tire but I found that after sliding the clamp off the front of the tire the rest of the boot was only hooked into the wheel from the rear. I got behind the wheel of the car, started it and drove it a few inches forward and the torque of the wheel immediately popped the boot completely off

That's just too damned funny. Remindes me of a similar story of a guy who got his car booted at his school. He was able to get a lug whench between the boot and the wheel; and just took the wheel off and left it there with the boot still attached.

The problem is the erosion of the notion of private property rights and absolute dominion - the commonwealth carried too far, IMO.

If you belong to an HOA, you purchase your property only with such rights as you have not covenanted away to the HOA at the time of purchase and as are not proscribed by laws and regs (federal, state, local, common law).

You have in essence ceded your property rights to your neighbors.

Software and particularly hardware licensing agreements raise many of the same issues as HOAs.

What I am wondering about, is that he bought the house, and there wasn't a homeowners association. Then one was implimented. I almost feel like there should be a grandfather clause that could exempt you from the rules and regulations of the HOA.

I didn't read it that way - I thought that the parking policy was later implemented.

I do not see any circumstance under which - short of legislation or a strange covenant - you could be forced to join a HOA after transfer of a title deed.

so far i am on page 22 and i am rolling. this is the funniest s**t i have read in a while. sounds like a cocky meter maid was lookin for a quota. granted he did say he forgot the pass. it happens to the best of us. but booting on first offense???? it almost sounds like poking someones eyes out for looking at you if you dont like them. come on! a notice would suffice. hell i have been in a "community" with an HOA. the rules were 2 cars per driver. we had 3 drivers 6 cars. perfectly within HOA rules. until we got sited for to many cars in the household. the rule hadn't changed but we were 3 cars over the limit. here is the math i understood. 2 cars per driver, 3 drivers, 6 cars total. but its more like 3 drivers 2 cars per driver, 3 cars total.

the 2nd place i was in liked to put tow notices on my cars 2 min after i got out of it coming home from work, siting it had been on blocks for too long. this would happen once a week. and every time i DROVE teh car up to the office, sticker in the window and say WTF??? never had a driver towed.

Dodges, Dubs, Ford, Chevy and now a Datsun. i am a glutton for punishment.

I keep reading about these HOA's, and I am only reminded of the county (and surrounding counties) I live in...NOT HOA communities...

Incident #1:

I had been working on my second (never heard anything about the first) project car, leaving it in the driveway simply because the garage was packed full of tools. Apparently, someone didn't like it and the "neighborhood watch"(also known as the neighborhood gestapo) came by during the day, photographed my car WITH ME UNDERNEATH, and sent a warning of impending citation in the mail...a citation relating my car to an abandoned vehicle...

Yeah, nevermind the guy underneath the car holding a ratchet, surrounded by various pneumatic tools, air hose trailing from compressor in the garage, etc.

This went on until we got the judge to throw it out...

Incident #2:

Another citation warning for "clutter on walkway/porch area". The attached picture? Why, it seems to be a clearly marked Fedex package!

I had been receiving numerous packages, and continued to receive them after the warning letter. So, I made sure to photograph every package, showing time/date of delivery...and waited for the citation.

Judge threw it out...

Incident #3:

This time, the neighborhood gestapo sent one with a picture showing the back yard...the 8 FOOT HIGH FENCED IN BACK YARD!

On and on...

Last I checked, I lived on MY property. Why in the HELL can't I use my property as I see fit?

Even more unbelievable would be that others actually conform to such unreasonable mandates.
